Automator & Partner Agreement

This agreement governs your participation in the SmashOne Automator & Partner Program. Please read it alongside our Terms of Service, Acceptable Use Policy, and Data Processing Addendum.

01Relationship

This Automator Agreement governs your participation in the SmashOne Automator & Partner Program. You are an independent contractor, not an employee, agent, or partner of SMASHONE CORPORATION. Nothing creates an employment, joint-venture, or franchise relationship. You have no authority to bind SmashOne.

02Roles

You may act in one or more roles: (a) Seller-Setup (you find and onboard a customer and configure their account), (b) Setup-Only (SmashOne matches you to configure a customer found by others/organically), (c) Referrer-Only (you refer via your link without setup).

03Compensation — Setup Fees

The customer setup fee is $199 (charged on the customer’s Day 15).

  • Path 1 (you sell + set up): you earn 70% × $199 = $139.30.
  • Path 3 / Path 4 (you only set up; referrer is someone else, or SmashOne matched you): you earn 50% × $199 = $99.50 (no referral commission).
  • Add-on setup fees (WhatsApp $49 / TikTok $39 / Google Business Profile $149) follow the same 70% / 50% split per role.

04Compensation — Referral (Lifetime)

If you refer a customer via your referral link, you earn 10% (Level 1) of that customer’s recurring subscription, plus 5% (Level 2) on subscriptions of customers referred by your Level-1 automators — paid for the lifetime of the active subscription (base + all add-ons). Referral commission accrues even if a different automator performs setup.

05Certification

Setup roles require active SmashOne certification before receiving matched setup orders. SmashOne may require completion of training/certification and may revoke certification for policy violations or poor quality.

06Customer Risk on Trial Cancel

If a customer cancels during the 14-day trial (Days 1–14), no charge occurs and no setup compensation is paid — the automator accepts this risk for setup work performed during the trial.

07Payment Terms

Commissions are calculated on successful customer charges (Day 15 and recurring). Payouts are made via the designated payment method on SmashOne’s standard schedule. Chargebacks, refunds, or reversals reduce or claw back the corresponding commission.

08Taxes (US)

You are solely responsible for all taxes on your earnings. SmashOne does not withhold taxes. U.S. persons must provide a Form W-9; SmashOne issues Form 1099-NEC where required. Non-U.S. persons must provide the applicable Form W-8; SmashOne reports/withholds per Form 1042-S where required. You receive no employee benefits.

09Conduct

You must comply with the Acceptable Use Policy, all platform rules, and applicable law (including the FTC Act and truth-in-advertising). You must not make false or misleading claims about SmashOne, its pricing, results, or features, and must clearly disclose your independent status. No guaranteed-results or income claims.

10Confidentiality & Data

Customer data accessed during setup is handled under the DPA and AUP; you may use it only to perform setup, and never for your own marketing or resale.

11Term & Termination

Either party may terminate with notice. SmashOne may suspend or terminate immediately for policy violation, fraud, or harm to customers/brand. Earned, non-reversed commissions accrued before termination remain payable subject to clawback for later refunds/chargebacks.

12Limitation & Governing Law

To the maximum extent permitted by law, SmashOne is not liable for indirect or consequential losses; total liability is limited to commissions paid in the prior 3 months. Governed by the State of Florida; venue in Palm Beach County, Florida; disputes subject to the arbitration and class-action-waiver terms of the Terms of Service. Contact: [email protected].
