Partner Program Terms

The SmashOne Partner Program lets a SmashOne customer recommend the service and earn a share of what the people they bring pay us. You take part from inside your own Workspace: there is no separate partner account, no application to approve and nothing to buy.

These terms are an agreement between you and SMASHONE CORPORATION, a Florida corporation (Document number P26000023598). They apply in addition to the SmashOne Terms of Service, Acceptable Use Policy and Privacy Policy, which continue to govern your account.

You may enrol if you have a SmashOne account in good standing — with or without an active subscription, whether you are a current or a former customer — you are at least 18 years old, and you are legally able to enter into this agreement. One person and one email address hold one partner profile.

Employees and contractors of SMASHONE CORPORATION, and members of their households, may not earn commission on their own accounts or on one another's accounts.

Referrals are attributed on a first-touch basis: the first partner link a new customer opens is the one credited, provided they create their account within 90 days of that first click. Opening the same link again does not restart the 90 days. A customer who signs up later than 90 days after the first click is not attributed to any partner. Once attributed, the customer stays yours for as long as they keep paying — the 90 days only decide whether the sign-up counts.

Attribution is recorded when the account is created. It is not applied to accounts that already existed, and it cannot be transferred, sold or assigned to another person.

Level 1: you earn 10% of what a customer you referred pays SmashOne.

Level 2: you earn 10% of what customers referred by partners you enrolled pay SmashOne.

Both levels are recurring and continue for as long as those accounts stay active and paying. There is no cap on how many people you may refer, and no time limit on how long a referral keeps earning.

The commission base is every commissionable line the customer is actually charged: each monthly AI employee instance and its channels, plus any other eligible purchase. Tax charged to the customer is not part of the base, and neither is any amount the customer does not in fact pay.

Commission accrues when the customer's payment succeeds, and is held as pending until it is paid out.

If a charge is refunded, disputed or charged back, the commission earned on that charge is reversed in the same proportion as the amount returned to the customer. A partial refund reverses a proportional part of the commission; a full refund reverses all of it.

A reversal is applied against your pending balance. If the pending balance is not large enough to absorb it, the shortfall carries forward and is set against your next commissions.

We do not accrue commission on a fraudulent, abusive or self-referred signup, and we may reverse commission already accrued on one.

Payouts are made in US dollars by SMASHONE CORPORATION. Before your first payout, we will request the tax and payment details needed to pay you and provide a secure way to submit them.

The payout threshold is $50. Once your pending balance reaches $50 it is scheduled for payout. A balance below $50 is not lost and does not expire: the whole balance carries over and is added to the next period.

Payouts are prepared after the close of the month in which the commission was earned, once the payment that generated the commission has passed the refund window that applies to it. How long the transfer itself takes after that is the payment network's timing, not ours.

If your payment details are incomplete, or the tax certification described below is missing, your balance keeps accruing and simply waits. It is not forfeited.

If your participation ends for any reason while a balance remains below the threshold, the threshold no longer applies: we pay out the whole of what you have properly earned at the next payout run, without you having to ask. If we cannot complete the payment, the money stays yours — we keep the amount recorded as owed to you and follow the unclaimed-property law of the state you live in. We never keep a balance because it was small or because you stopped being a customer.

Commission is income to you. You are responsible for reporting and paying any tax due on it. We do not deduct any tax from your payouts.

If you are a US person, you must provide a completed Form W-9 before your first payout. We report payouts on the US 1099-NEC form where the total we pay you in a calendar year reaches the reporting threshold set by the Internal Revenue Service.

If you are not a US person, you must provide the applicable Form W-8 instead. Until the required tax form is on file your payouts are held, not cancelled.

You are responsible for any sales, use or similar tax that your own jurisdiction charges on the commission you receive.

The program rewards genuine recommendation. Any of the following ends your participation and forfeits the commission concerned:

• Self-referral: signing up through your own link, under your own name, another email address, a company you control, or a person acting on your behalf.
• Unsolicited promotion of any kind, including bulk promotion such as email blasts and mass direct messages, comment spam, or posting into forums, groups and review sites against the rules of the venue. Your promotion must comply with the CAN-SPAM Act, the Telephone Consumer Protection Act and any other law that applies to you.
• Any SMS, MMS or other text message to a telephone number promoting SmashOne, unless that person affirmatively opted in to receive them from you and you can produce the record. Never use automatic dialling, bulk-SMS software, prerecorded or artificial voice, or ringless voicemail to promote SmashOne.
• Contacts obtained by scraping, purchase, rental, harvesting, list appending, automated extraction from a platform, or in breach of any website's or service's terms.
• Appointing anyone — a sub-affiliate, a lead generator or a messaging vendor — to promote SmashOne on your behalf. You promote SmashOne yourself. Enrolling another person as a partner is not the same thing, and does not make them your subcontractor.
• Bidding on the SmashOne name, our product names or misspellings of them in paid search, or running ads that appear to originate from SmashOne.
• Presenting yourself as SmashOne, as an employee or agent of SmashOne, or as authorised to speak, quote prices or contract on our behalf.
• Claims about price, capability, results or earnings that we have not published, including any guarantee of income.
• Cookie stuffing, forced clicks, automated signups, fake accounts, or any other attempt to create an attribution that a real person did not choose.
• Offering a cash rebate or other inducement to sign up through your link, unless we have agreed to it in writing.
• Registering domains, social accounts or listings that contain the SmashOne name or a confusable variant of it.
• Promoting SmashOne alongside illegal, hateful, deceptive or adult content.

Whenever you mention, recommend, review, compare, demonstrate, link to or otherwise promote SmashOne anywhere — a post, a video, a live stream, a story, a direct message, a group or community, your own website, an email, or a conversation in person or by phone — you must say clearly that you earn a commission. The disclosure must appear before or together with the recommendation, must be easy to notice and easy to understand, and must be in the same language as the recommendation itself. In a video that is both seen and heard, say it as well as show it.

A wording that always works: "Paid referral — I'm a customer and I earn a commission if you subscribe through my link."

If you are no longer a customer, say "I earn a commission" without claiming to be one.

It is not enough to put the disclosure in your profile, in a footer, behind a "more" link, on a separate page, or among a block of hashtags. Words such as "affiliate", "partner" or "collab" on their own do not tell people that you are paid. Where a platform provides a paid-partnership or commercial-content label, you must switch it on in addition to — never instead of — the wording above.

Do not post reviews of SmashOne on third-party review sites, app directories or marketplaces unless that site's own rules permit reviews from people who are paid, and you disclose the commission there as conspicuously as everywhere else.

Before your referral link becomes active you confirm that you have read these disclosure rules. We check public promotion for compliance. If something is missing we tell you and give you a deadline to fix it; if it happens again, or if it was deliberate, your participation ends.

You take part as an independent contractor. Nothing here creates employment, partnership, joint venture, franchise or agency between you and SMASHONE CORPORATION, and you have no authority to bind us or make commitments for us.

You cover your own costs of promotion. Nothing is owed to you for effort; only commission actually earned under these terms is payable.

You may describe SmashOne and link to it. You may not use our name or logo in a way that suggests we endorse you, and any use must follow the brand guidance we publish.

If you pass us the contact details of a person you referred, you must be able to produce the actual record of that person's permission — what they were shown, what they agreed to, when, and that it names SmashOne. We do not call or message a lead on your word that permission exists. Data about your referrals is shown to you in masked form, and you may not use it for any purpose other than the program.

You may leave the program at any time from your Workspace. Commission already earned and past its refund window is paid at the next payout run; pending commission continues to settle normally.

We may suspend your partner profile while we investigate a suspected breach, fraud or abuse. While suspended you keep read access to your history, and your link stops attributing new signups.

We may end your participation, with notice to the email address on your account, if you breach these terms, the Terms of Service or the Acceptable Use Policy. Commission tied to fraudulent or abusive activity is forfeited; commission properly earned before termination is not.

Cancelling your subscription does not end your participation. Your partner profile, your referral link and the commission you have already earned stay with you; new commission continues to accrue for as long as the accounts you referred stay active and paying. Only closing your SmashOne account itself, or a breach of these terms, ends your participation.

We may end or suspend the program itself on 30 days' notice to the email address on your account. If we do, links stop attributing new signups at the end of that notice and the balance you have properly earned is paid out under these terms.

We may change these terms. Every version carries a version number, and the version you accepted is recorded together with the date you accepted it.

The current version is always published at smashone.us/partner-terms/ and shown to you in your Workspace before you enrol. A change to the commission rates, to the commission base or to the payout threshold applies from the date the new version takes effect, and never to commission you have already earned.

If you do not agree with a new version, your remedy is to leave the program as described above.

The program is provided as it stands. To the fullest extent the law allows, our total liability to you in connection with the program is limited to the commission properly earned and unpaid at the time the claim arises.

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, except to the extent that a non-waivable law of the jurisdiction where you live applies to this agreement. Disputes are resolved under the dispute-resolution section of the SmashOne Terms of Service, which is incorporated here by reference, including any agreement to arbitrate and any waiver of class proceedings stated there.
