Copyright & DMCA Policy

SmashOne respects the intellectual property of others and expects the businesses using the Service to do the same. This policy explains how to report copyright infringement, how counter-notification works, and what happens to accounts that repeatedly infringe. It is part of our Terms of Service and applies to all content published or stored through the Service.

Reporting copyright infringement

If you believe content published through SmashOne infringes your copyright, send a notice to dmca@smashone.us. Under 17 U.S.C. §512(c)(3), an effective notice includes:

  1. Identify the work — describe the copyrighted work you believe is infringed (or a representative list).
  2. Identify the material — the exact URL or channel post that you want removed, with enough detail for us to find it.
  3. Your contact information — name, mailing address, telephone number, and email address.
  4. Good-faith statement — that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement — that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act for the copyright owner.
  6. Signature — a physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receiving a valid notice we act expeditiously to remove or disable access to the identified material, notify the account that posted it, and record the complaint in that account’s history. Knowingly misrepresenting that material is infringing may make you liable for damages under 17 U.S.C. §512(f).

Counter-notification

If your material was removed and you believe the removal was a mistake or misidentification, you may send a counter-notification to dmca@smashone.us containing, per 17 U.S.C. §512(g):

  1. Identify the removed material — and where it appeared before removal.
  2. Good-faith statement under penalty of perjury — that the material was removed as a result of mistake or misidentification.
  3. Your contact information — name, address, telephone number.
  4. Consent to jurisdiction — of the federal district court for your address (or any judicial district where SmashOne may be found, if outside the United States), and that you will accept service of process from the person who filed the original notice.
  5. Signature — physical or electronic.

We forward valid counter-notifications to the original complainant. Unless they inform us that they have filed a court action, the material may be restored within the timeframe the DMCA prescribes.

Repeat infringer policy

We terminate, in appropriate circumstances, the accounts of customers who are repeat infringers. This is how that works in practice:

  1. History lives at the account level. Infringement complaints are recorded against the customer account — not against an individual connected channel. Disconnecting one channel and connecting another does not reset an account’s history.
  2. We keep records. Every DMCA notice, counter-notification, and the action we took is logged and retained.
  3. Repeated infringement ends the service. An account that accumulates repeated substantiated complaints is suspended or terminated in its entirety — all channels, all AI employees. We weigh the circumstances (number, timing, counter-notifications, whether infringement was knowing), and we do not operate a system that lets a terminated account return under a new name to continue the same conduct.
  4. AI-assisted publishing is not an exception. Content scheduled or published by an AI employee on your behalf is your content. Complaints about it count toward your account’s history the same way manually posted content does.
